生日快樂歌版權糾紛 美商告華納

「祝你生日快樂，祝你生日快樂…」《生日快樂歌》的旋律全世界民眾耳熟能詳。美國紐約製片公司「早安你好製作公司」十三日提出告訴，主張這首《生日快樂歌》屬於每一個人，要求聯邦法院諭令華納音樂集團旗下「華納/查普爾音樂公司」返還以前收取的數百萬美元授權金。

華納/查普爾聲稱擁有《生日快樂歌》的版權，若有人重新製作或公開演唱，就須繳交授權金。

「早安你好製作公司」正在製作《生日快樂歌》紀錄片，該公司力陳，生日快樂歌的旋律搭配簡單歌詞已有一百廿多年歷史，華納/查普爾擅自堅稱擁有其版權，「不正當也不合法」。訴狀說，華納/查普爾每年收取這首歌曲的授權金至少有兩百萬美元。

早安你好製作公司聲稱，生日快樂歌最早於一八九三年以《祝大家早安》（Good Morning to All）的曲名發表，當時是由一對姐妹花派蒂和密德蕾德．希爾作詞譜曲。不久之後大家開始傳唱「祝你生日快樂」。
