申請達卡的條件

申請達卡有一些基本的要求，必須是童年入美，包括：1）在2012年6月15日時年齡不到31歲。2）在16歲生日之前到達美國。3）自2007年6月15日到現在一直居住在美國。4）2012年6月15日時人在美國，而且從這一天起到提交DACA申請一直在美國。5）在2012年6月15日之前未經邊檢入境，或者在這一天時身份證件已經過期。

達卡要求申請人在2012年6月15日時年齡不到31歲，而且提出申請時年齡已經至少15歲，除非是正在遞解程序中，或者要被遞解，或者有自動離境令。根據這一規定可以區分為兩種情況：

一種情況是申請人沒有進入遞解程序，或者在申請之前遞解程序已經終止。這種情況人，要求申請人在提交申請人年齡至少15歲，而且在2012年6月15日時年齡不超過31歲。

另一種情況是申請人正在遞解程序中，接到遞解出境的最終決定，或者有自願離境命令，但是不能在移民監獄。這種情況下，申請人要在2012年6月15日時年齡不超過31歲，但對提交申請人的年齡則沒有更進一步要求。

除了以上普遍的要求以外，達卡要求申請人現在正在上學，或者從高中畢業並獲得了畢業證明，獲得了普通教育發展證書（General Education Development，簡稱GED）。或者是從美國海岸警衛隊或軍隊退伍。而且，和所有移民政策一樣，有犯罪記錄的人不可以申請達卡。移民局要求申請達卡的人沒有犯過重罪、嚴重的輕罪、三次或以上的輕罪。同時，不能對國家安全和公共安全造成威脅。

申請達卡的流程

對於符合上述要求的非法移民，可以向移民局提出申請，申請包括以下幾個步驟：

第一步，提供符合條件的證明材料。移民局建議的證明材料包括：1）身份證件 。包括護照、身份證、出生證明（帶照片）、學校或軍隊提供的帶照片證件，以及其他由美國政府提供的附有申請人名字的文件。2）證明自己在16歲生日前來美國。包括帶有入境邊檢印的護照、I-94/I-95/I-94W卡、在美國上學的記錄、其他移民局或國土安全局提供的附有申請人入境日期的材料，包括出庭通知。旅行記錄、醫院或醫療記錄。3）移民身份證明。帶有官方許可留美日期的I-94/I-95/I-94W卡、遞解出境的最終行政命令、進入遞解程序的指控文件。4）持續身在美國的證明。這類證明包括兩個方面，一方面是要證明申請人2012年6月15日時身在美國，別一方面則是要證明自己自2007年6月15日以後一直在居住在美國。這類證明包括：租金收條、水電氣單子、就業記錄、學校記錄、參軍記錄、宗教機構提供的參加宗教活動的官方記錄、跨境匯款記錄、護照記錄、孩子在美國出生的出身證明、標有日期的銀行轉賬記錄、社會安全卡、貸款或租賃合約、報稅記錄和買保險的記錄。5）提供上學的記錄。包括學校的報告、高中學位或畢業證書、GED證書。6）退伍證明。包括DD-214表、NGB表22、軍隊人員記錄、軍隊健康記錄等。

上述證明材料中，5）和6）只要有一項就可以了。

第二步，填表與交費。要填的表包括I-821D表（《考慮童年入境暫緩遞解表》）、I-765勞工紙申請表、I-765WS表。在I-765表中的第16個問題，是關於申請就業許可的依據，就填C33。申請的費用為465美元，其中包括380美元的申請費，以及85美元的生物采證服務費，費用不可以豁免。

根據移民局的解釋，如果I-765表被批，也就是申請下來工卡（I-766），就可以申請社會安全號。

在完成以上幾步以後，要將申請材料寄到移民局，移民局會安排時間采指紋。沒有完整填寫上述表格，或者沒有交費的表格將會被退回。然後，就可以在網上查詢案件進展，移民局大概需要90天時間來審批I-765和I-821D表。

申請達卡後能否回國？

申請達卡對出境旅遊記錄有要求，分為兩種情況：一種是在2007年6月15日與2012年8月15日之間進行的旅行，只要時間很短、而且是很隨意的旅行，不會影響連續居住的要求。如果是長期旅行，或者是因為遞解令出境，或者是參與違法活動，則是會影響連續居民的要求的。另一種是在2012年8月15日與提交申請之間進行的旅行，任何旅行都會影響連續居民的要求。

在提交申請以後，在申請被受理期間，申請人不可以離境，在國土安全局決定是否允許暫緩遞解之前，也不可以申請回美證。在申請被批以後，可以提交I-131表申請回美證，如果沒有獲得回美證就出境，將會自動取消達卡。而且，移民局只批準為了教育、就業、人道（就醫、探親）原因的旅行，不可以為了度假出境旅行。

【張欽／台北報導】接任法務部長的行政院政務委員羅瑩雪，上午接受訪問，面對死刑執行議題時說：「若在任內有必須執行的死刑，該做的事不會推拖。」對此廢死聯盟執行長林欣怡回應說：「若部長執意執行死刑，必須確保不會發生錯誤，也不會再次造成如江國慶等冤案的悲劇，希望部長能好好思考這個問題。」
 
林欣怡還指出，法務部是2公約主管機關，新任部長上任後應面對如何落實公約要求，並總結專家結論性意見，包含執行死刑、迫遷議等人權議題，林欣怡認為，法務部這段時間做得很糟糕，期許羅瑩雪能正視這些問題，不要帶頭違法。
