罵建商「烏魯木齊」　男判無罪

【許淑惠／台中報導】中市潘姓男子2009年間向君鑑股份有限公司購買「山水一品2」預售屋，交屋後，潘男認為房屋有諸多瑕疵、坪數不足等，今年6月氣得在房屋2樓雨棚掛看板寫「君賤山水黑心，詐欺坪數不足」、「烏、魯、木、齊」(按閩南話為粗製濫造意思)，遭業者控告加重誹謗罪，但台中地院以潘男指摘內容有憑據，判他無罪。
 
台中地院指出，經鑑界測量該屋土地確實減少7.12平方公尺，雙方也數度針對車道坡度過高、地面抿石子有裂痕等問題協調，潘男所言有所憑據，主觀上即無誹謗惡意。
 
法官也指出，現今房價高漲，民眾動輒花費上千萬元購屋，建設公司信譽、建築品質優劣、服務態度等，皆為民眾所需的資訊，為保障民眾知的權利，應使相關資訊在言論市場上公開流通，供民眾作為購屋擇優汰劣的參考，認定潘男所為與公共利益息息相關。
