酒後移車被控酒駕　機車行老闆不起訴

【黃哲民／新北報導】在新北市經營機車行的30多歲林姓男子，去年9月凌晨1時許在店內喝完酒，起身要收拾店面打烊，發動停在店外的機車騎進店內，當場被警員攔查，因酒測值超標，被依最重可判2年的酒駕罪嫌送辦。新北地檢署今認定林男當時僅為移車，不算在「道路」上行駛，將林男不起訴。

林男坦承被攔查做酒測，呼氣酒精濃度為每公升0.39毫克，高於法定0.25毫克的標準，但辯稱當時正要把客人的機車從騎樓牽進店內，因門口有個台階，才發動引擎「催一下油門」騎進店裡。

檢方指警員取締時沒錄影蒐證，無法證明林男是從路邊還是從騎樓把車騎進店內，但林男整體行車過程僅止一瞬，與民眾常見違規沿著騎樓、人行道騎乘機車而有行車延續性的情形有別，難以認定林男舉動會對往來交通產生何種危險。
