勞基法這樣會被檢舉嗎?

1 公司員工包含老闆及家屬3人，還有2位工讀生，共有5名員工，經營餐飲業，老闆沒幫員工投保勞保，但每個月補貼員工500元保險費，請問這樣有違反勞基法嗎?

2若不是員工的檢舉而是被無聊人士檢舉，會被開罰嗎?
