高市議員蕭永達亮票案二審改判無罪定讞

【王吟芳／高雄報導】民進黨籍高雄市議員蕭永達在2010年間議會選舉正副議長時技術性亮票遭檢方起訴，高雄地院一審判決有罪，蕭永達上訴後，高雄高分院審理認定亮票不等於洩密，機關內選舉也不適用可處罰亮票行為的《公職人員選舉罷免法》，改判蕭永達無罪定讞。

高雄市議員蕭永達被控於2010年12月25日參加高雄縣市合併後首次正副議長選舉時，為表明支持民進黨推出的候選人康裕成、蔡昌達，分別基於洩密犯意，在領得正副議長選票，於圈票處圈選完畢走出後，將選票攤開正面朝上持續數秒，使站在圈票處旁之同黨籍監察員林武忠、張豐藤均可得看見所圈選內容，一審被依刑法洩密罪判刑5月，得以15萬元易科罰金。
